1. Driving laws in Spain (27/09/11)

For your information, we list below a summary of  Spanish traffic legislation, last modified by law 18/2009, Boletin Oficial del Estado Nº283 (24/11/09). For further or more up to date information, please go to http://www.dgsfp.meh.es

Points System:

A new driver begins with 8 points. After 3 years with no deductions, this goes up to 12. After a further 3 years, up to 14 points, and a driver can obtain a maximum of 15 points with a further 3 years or more without deduction.

If a driver loses all points, when he regains his licence he will begin again with 8 points. However, if he successfully completes a course on “sensitization and re-education” he can regain a maximum of 6 extra points.

Points are only deducted for offences that directly compromise road safety.

2. Points deductions

6 points will be deducted for:

      • Driving under the influence of alcohol (more than 0,50 mg/l).
      • Driving under the influence of drugs
      • Refusing to undergo breath tests
      • Driving in the wrong direction
      • Driving in  unauthorised races or competitions
      • Dangerous driving
      • Driving vehicles which have mechanisms installed aimed at avoiding police controls or inhibiting radar detection systems.

 

4 points will be deducted for:

        1. Driving under the influence of alcohol (0,25-0,50 mg/l)
        2. Driving without a valid driving licence.
        3. Throwing objects out of the vehicle which may cause fire or accident.
        4. Driving irresponsibly
        5. Failing to respect right of way
        6. Failing to respect a STOP sign
        7. Failing to respect overtaking laws
        8. Reversing on motorways
        9. Accelerating to prevent other vehicles from overtaking
        10. Overtaking on bends or when visibility is reduced
        11. Failure to obey traffic police
        12. Failure to obey traffic lights
        13. Not respecting distances with vehicles in front.

 

3 points will be deducted for:

        1. Changing direction in dangerous situations, such as tunnels, junctions, motorways and roads where overtaking is forbidden.
        2. Driving whilst using other devices which prevent the driver from paying full attention (mobile telephone, headphones etc)
        3. Driving without seatbelt, helmet or other compulsory protective devices. The driver is also responsible for passenger compliance.
